Flight canceled: how to get 250-600 € and hotel payment

A familiar situation for many: you are already at the terminal, and across from your flight the board shows "Cancelled". Sometimes the carrier immediately offers another flight. Sometimes you stand at the desk with no explanation and no hotel for the night.

The amount of compensation and the set of services depend on one detail: how far in advance you were notified of the cancellation. Let's look at what amounts and services you are entitled to and how to get them without unnecessary runaround.

If you only learned about the cancellation at the airport, go to your airline's desk. If there is no representative, look for any carrier employee at the boarding gate.

Record everything that can be confirmed: the scheduled departure time, exactly what you were told, the details of the replacement flight offered.

Put the document in writing, at least by hand on a sheet of paper. Ask one or two witnesses to confirm it and be sure to write down their contact details.

Keep all receipts: hotel, taxi, water and food in the terminal. Without receipts, recovering these expenses is almost impossible.

A separate rule applies to package tours. Notify the tour operator of the cancellation immediately, preferably with witnesses present, and ask for written confirmation. It is enough if the group leader writes "noted" on your statement.

Important: do not leave the airport silently. Until you have reported the problem and left a trace of your request, there is almost nothing to prove later.

Ask for written confirmation of the cancellation. If the employee refuses to provide a document, send a short message to the carrier's support service right from the terminal. Include the booking reference, flight number and time of your request.

Under EU rules, notice of your rights is posted at the check-in desk and appears during online check-in. If there is no such notice, record that too.

While you wait for a response, make a list of alternative flights on the same day. That way you are requesting a specific option rather than accepting the first one offered.

Keep your boarding pass handy. Even if you did not fly, it confirms that you checked in and showed up for the flight.

If you have to wait several hours, do not buy food silently. Ask for meal vouchers at the desk and keep the receipt if the carrier refused.

Record the time of each step: when you learned about the cancellation, when you contacted them, when you received a response. In a dispute, minutes and hours become an argument.

Photograph everything that shows reality: the board, the queue at the desk, announcements over the loudspeaker. You cannot rewrite the text of a message, so at least record the time and the gist.

Who you need to notify about the cancellation

A flight cancellation triggers a chain of rescheduling. The sooner you notify everyone else, the less money and bookings you lose.

  • The tour operator, if you have a package tour: they are responsible for the entire trip.

  • The hotel or apartment, so they expect you on a different day and your booking does not lapse.

  • The car rental company, if you are not picking up the car on time.

  • The ferry company, if you can no longer make its departure.

Write briefly and to the point: booking reference, new arrival date, request to reschedule. Keep the response, it will be useful when getting your money back.

Do not wait for the airline to sort everything out itself. Hotels and rental companies often accommodate you if you warn them in time.

When you were notified of the cancellation

This is where the main fork lies. Under Regulation (EC) 261/2004, compensation depends on the notice period and on how convenient the replacement offered to you was.

If you were offered a flight within these limits, the carrier is not obliged to pay compensation. If there was no replacement at all or it does not suit you, you become entitled to payment.

Delay to the final destination is considered separately. A delay of many hours has been equated to cancellation by a ruling of the EU Court of Justice if it exceeds the threshold set out in the rules. Look not only at the fact of cancellation, but also at how your day ended.

The difference between the three notice periods is not accidental. The later the carrier notifies you of the cancellation, the less time you have to make alternative arrangements yourself. That is why shorter notice periods give you more rights.

Look for the exact date and time of notification in writing: in the carrier's email, in the app's push notification, in an SMS. A screenshot of the email with the date will be useful if the dispute reaches correspondence.

Count the period from the departure date of the cancelled flight, not from the ticket purchase date. Linking the notification to the moment of ticket payment is incorrect.

If one leg of two was cancelled, the threshold is still calculated based on the final destination of the route. An intermediate stop changes nothing.

For a round trip, the periods are calculated separately for each segment. The cancellation of the return flight is assessed based on the return departure date.

Also record the replacement information: the departure and arrival times of the offered flight show whether it falls within the allowance.

If the carrier offers a replacement with a significant delay, you have the right to refuse and demand money. The right to compensation remains in that case.

For families with children and elderly passengers, it is worth clarifying separately what counts as reasonable waiting. Such details are often decided by a court, not by the desk at the airport.

A short route like Frankfurt to London is about 640 km, so it falls in the first row of the table and €250 per passenger. A long flight across the ocean falls in the third row.

An important nuance: if you arrive late, the carrier has the right to cut the payment in half. This applies when the delay is no more than 3 hours on medium routes and no more than 4 hours on long routes (regulation text).

The right to compensation does not apply to all flights. You are entitled to it if the flight departs from an EU airport. The second case: you are flying into the EU on an EU carrier. The rule does not apply to a flight from a non-EU country into the EU on a third-country carrier (according to the European Commission).

When compensation is not paid: extraordinary circumstances

Even when a flight is canceled without a convenient alternative, there is an exception. The carrier does not pay if it proves that the cancellation was caused by extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken.

Such circumstances include bad weather, strikes by third parties (for example, air traffic controllers), terrorism warnings, natural disasters, and bird strikes. Whether a particular case falls under this exception or the general rule is decided by a court, and the dispute often drags on.

A technical fault with the aircraft is not considered an extraordinary circumstance. An airline's reference to a "breakdown" can be challenged.

In practice, the dispute is almost always about the cause of the cancellation. The carrier cites weather or a strike, the passenger objects. Such cases have to be resolved through correspondence and sometimes in court.

What helps you: requested documents stating the reason for the cancellation. The carrier is required to explain the cancellation, not just say "for technical reasons."

If the cancellation was caused by a delay of the carrier's own previous flight, that is not an extraordinary circumstance. An airline's internal disruptions remain its responsibility.

Also look at the chain of events. If your flight was canceled because the aircraft was stuck due to weather in another city, a dispute over the cause is possible.

Be careful with the word "safety." It sounds convincing, but it requires proof. A single phrase in a letter is not enough.

Checklist for a dispute: confirmation of the cancellation, the reason from the carrier, your expenses with receipts, correspondence. With this set, your position looks stronger.

If the carrier stays silent beyond the deadline you set, contact the passenger rights authority. They will determine whether the case qualifies for the exemption.

The right to a replacement flight or a refund

You have a choice. The carrier must offer either another flight or a full refund of the ticket price.

First option: rebooking on the earliest possible flight or at a time convenient for you, if seats are available. The airline must not charge extra for this. Sometimes you may be taken to your final destination by train, bus, or ferry if that is faster.

Second option: you decide not to fly. The carrier must then refund the full ticket price, including fees and taxes.

If there is no replacement or it is inconvenient, and cheaper flights are available, set a deadline for the airline to respond. A flight on another airline is also acceptable, so mention that in your claim as well. In practice, the length of the deadline depends on the time before departure: if the flight is months away, about two weeks is reasonable; if you are standing at the airport, a few hours is enough.

Canceling the contract: what you lose

If you demand a refund for a canceled flight, you are thereby canceling the contract of carriage. This matters, because some rights disappear along with the contract.

You arranged a replacement yourself after canceling. Then the additional costs can be claimed as damages, but only if the cancellation was caused by the airline itself. If the cause was extraordinary circumstances, your chances are slim.

After canceling, you lose the right to care: food and a hotel are no longer provided. But rights accrued during the wait before cancellation remain. For example, if you were told about the cancellation only after several hours in the terminal.

The full ticket price must be refunded, even if you already flew part of the route and were stranded at a connection. In that case, you are also entitled to a return flight to the first airport of departure.

With a package tour, you have no contract of carriage with the airline. You can cancel the contract with the tour operator only if there is a significant deficiency in the trip. A flight cancellation is usually considered a minor deficiency: it gives you the right to a price reduction, but not to a full cancellation. The exception is short tours of a couple of nights, where the cancellation defeats the entire purpose of the trip.

Food, hotel, and more: passenger care

A long wait at the airport turns rights into services. The carrier must provide free snacks and drinks, as well as the opportunity to make two phone calls, send two emails, or send a fax (EU passenger rights).

If you cannot fly out the same day, the airline must arrange a hotel for you and pay for the trip there. For a canceled return flight, this means an extended vacation until a seat becomes available.

With early notice of a cancellation on the outbound flight, a wait usually does not arise. With notice a couple of hours before departure, when you are already on your way to the airport, a wait is almost inevitable.

The carrier refuses to provide food and accommodation? Arrange everything yourself and keep the receipts. You can later claim these expenses from the airline, but on one condition: you must have the receipts.

How long counts as a long wait depends on the length of the delay and the route. Short flights and long-haul flights are assessed by different thresholds.

Two phone calls and two messages are a minimum under the rules, not a courtesy from the desk. Ask for them directly and do not accept "call yourself, we'll sort it out later."

The hotel is paid for by the carrier, but the choice is often yours. If the offered option is far from the airport and you pay for a taxi yourself, keep the receipt and include the amount in your claim.

Transfer to the hotel and back is also part of the care services. This applies even if you have already checked your baggage and passed through security.

The rules are the same for families with children. Food, water, and a place to rest are provided to all passengers, not only to adults traveling alone.

If the carrier offers a voucher instead of cash, ask about the hotel. A meal voucher does not replace accommodation.

Damages: what you can recover

Compensation under the regulation does not cover everything. You can separately claim damages that arose from the cancellation.

This includes the price difference for a new ticket, a paid but unused hotel, a missed ferry or transfer, and a taxi ride home to wait out the night.

The carrier from which you bought the ticket is liable, but only if the cancellation was caused by a breach of the contract of carriage. It is released from liability by proof of no fault: a flight ban, air traffic control disruptions, a strike by controllers or third-party services, bad weather.

A technical fault does not release it from liability. And compensation already paid will be offset by the carrier against the damages.

Keep a list of expenses from day one. That way you will not forget small items that add up to a noticeable amount.

A separate line item is a ruined vacation. If paid excursions or hotel days were lost due to the cancellation, include them in your claim as well.

Unused hotel: if you could not check in because of the cancellation, ask the hotel for a written refusal to refund. With that document, it is easier to claim the amount from the carrier.

A missed transfer or ferry is confirmed by bookings and correspondence. Attach the cancellation correspondence too, not just the receipt.

The trip home and back to the airport also counts. Keep taxi and bus tickets.

Do not round amounts at random. Support each one with a receipt or invoice, otherwise the carrier will reject the entire item.

Compensation and damages are different claims. You can submit them together, but in the application it is better to separate them into distinct items.

Claims against the tour operator for a package tour

It is a different story if the canceled flight was part of a package. In that case, you file your claims not with the airline, but with the tour operator.

There are three possible options: a price reduction for the tour, termination of the contract, and compensation for lost vacation days. The last one requires proving that the vacation did not go as planned.

Write to the tour operator and demand a response. Verbal promises are worthless in such disputes.

In the letter, describe exactly what went wrong and what amounts you are claiming. Attach documents about the cancellation and receipts.

The price reduction is calculated from the tour cost for the days that were ruined. The more ruined days, the higher the refund share.

Termination of the contract is possible when the vacation lost its purpose entirely. For a short tour of a couple of nights, this is a realistic path; for a long package, it is more difficult.

Compensation for lost vacation days requires evidence. Describe which plans fell through and why the vacation itself was ruined, not just one trip.

Separately check who you paid. If the payment went to the tour operator rather than directly to the airline, file the claim with the tour operator.

Set a response deadline in writing. If the tour operator stays silent, contact the same consumer protection service as in the airline case.

What to do if a replacement flight ruins your plans

A flight cancellation puts the whole trip at risk: car rental, ferry, business meetings, bookings for specific dates.

If the offered flight does not suit you or there is no replacement, contact the carrier and set a deadline for a proper offer. This is better than immediately demanding money: by refusing, you lose your right to care.

After that, it depends on how much time you have. The more days before the trip, the more calmly you can insist on a convenient option. New damage caused by the cancellation and the timing of the replacement often becomes the very basis for claims.

Business meetings and bookings with a fixed date are harder to reschedule. Real losses for them are confirmed with invoices and contracts.

Do not cancel other bookings in the heat of the moment. First get a written refusal or an unsuitable replacement from the carrier, then act.

If the replacement means arriving a day later, calculate exactly what you lose. That amount is the basis for discussing damages.

If the trip falls apart entirely, calculate the total damage and submit it together with the compensation claim. Break the claim down into line items so nothing gets lost.

Keep correspondence with the hotel and rental company. It will confirm that you tried to resolve the issue, not just demand money.

How to file a claim: step by step

Send the claim in writing to the carrier itself, not through a form on an intermediary's website. That makes it easier to prove that you contacted them.

Attach your boarding pass or booking, confirmation of the cancellation, and receipts for expenses. Describe what happened without unnecessary emotion, and set a deadline for a response.

It is useful to prepare the claim using a template: consumer advice centers have templates for cancellations and for claims about trip deficiencies. A ready template saves time and reduces the risk of forgetting a necessary point.

In the claim, list your demands as line items: compensation, ticket refund, hotel and meal expenses. That way each item can be tracked separately.

Set a realistic response deadline, usually two to four weeks. A date in the letter disciplines the carrier and will be useful if you file a complaint.

Send the claim by a method with confirmation: registered mail or through a form with a reference number. A screenshot with the date also works.

Keep all correspondence in one folder. Correspondence is often more important than the receipts themselves when the dispute is about the reason for the cancellation.

Write calmly and stick to the facts. Emotion in a claim does not help, and unnecessary judgments only give grounds for refusal.

How much time you have: a three-year period

Do not put off filing. In Germany, a claim in such a dispute is valid for three years, and the period does not start on the departure date (§ 195 BGB). The period is counted from the end of the year in which your flight departed.

In practice, this means: a 2023 flight can be disputed until December 31, 2026 (§ 199 BGB). After that, the claim expires. In other EU countries, the periods may differ, so check in advance.

Counting from the end of the year is not immediately intuitive. It seems like there is plenty of time, but three years pass quickly, and documents get lost.

If the flight was at the beginning of the year and you file at the end of the third year, the buffer seems large, but correspondence takes months. Do not wait until the last moment.

The period is suspended while correspondence with the carrier is ongoing. That is why a written inquiry is not just a courtesy, but also protection of your rights.

If you handed the matter to specialists, clarify who is monitoring the deadline. An expired claim cannot be restored.

The departure date is on the boarding pass and in the booking. If no papers remain, a card statement and a letter from the carrier about the cancellation will work.
